Swift Claim Resolution After Public Road Incident

Picture3

CASE STUDY:

Tigermar responds when an umbilical winch came off its transporter during its road transit within Europe.

This incident involved an umbilical winch which came off its transport during road transit within Italy.  It was reported in the local press, as the winch destroyed a concrete barrier and damaged the road, although thankfully there were no injuries. As such, this case required efficient and sensitive handling, which our many years of claims handling experience was able to provide.

We immediately notified subscribing Equipment Insurers of the case. The incident occurred during renewal conversations; however, we were able to satisfy Insurers to honour their renewal terms, a great help to the Insured.

Insurers instructed a surveying company with whom Tigermar has worked extensively in the past and have a great working relationship. They inspected the winch and requested maintenance records from the Insured. The Insured had recently implemented a new computer system and struggled to obtain these records, but through our substantial knowledge of the policy and our understanding of Insurers’ requirements, as well as our collaborative relationship with the Surveyor, we assisted the Insured in obtaining the correct information to the Insurers’ approval.

Equipment Insurers approved the claim in principle, subject to confirmation that the rights of recovery against the transport company were subrogated to them. An important skill of claims handling involves engaging with third parties, and along with our ambition to always go the extra mile to assist our clients, we as brokers undertook the responsibility of liaising with the transport company and their surveyor. We were in productive communication with them when the transport company appointed a lawyer to advise them. We knew from experience that this could lead to substantial legal fees and could prolong the finalisation of the case, and as such recommended to the Insured that it was in their best interests to cease this approach, confident in our ability to successfully explain the situation to their Insurers.

Indeed, our excellent negotiating skills enabled us obtain Insurers’ agreement to pay the claim, despite the challenges. With our expertise as brokers and our drive to always exceed expectations upon us as claims handlers, the case was concluded with the outcome we always work toward, the best possible result for our Insured.
